Purchase Terms

Danelli Ocular Creations LLC (“DOC,” “we,” “us,” or “our”) operates this website (the “Site”) and may offer DOC’s products (the “Products”) for purchase on the Site. By making a purchase on this site you agree to the following terms and conditions, in addition to the terms of the Legal Notice and Privacy Policy. If you disagree with or do not accept any part of these policies or terms do not make a purchase.

Return and Exchange Policy

Returns:

We accept returns. You can return unopened items in the original packaging within 30 days of your purchase with receipt or proof of purchase. If 30 days or more have passed since your purchase, we cannot offer you a refund or an exchange.

Upon receipt of the returned item, we will fully examine it and notify you via email, within a reasonable period of time, whether you are entitled to a return. If you are entitled to a return, we will refund your purchase price, less a 20% return processing fee, and a credit will automatically be applied to your original method of payment.

Only regular priced items may be refunded. Sale items are non-refundable.

Refunds do not include any shipping and handling charges shown on the packaging slip or invoice. Shipping charges for all returns must be prepaid and insured by you. You are responsible for any loss or damage to hardware during shipment. We do not guarantee that we will receive your returned item. Shipping and handling charges are not refundable. Any amounts refunded will not include the cost of shipping.

Exchanges:

We only exchange goods if they are defective or damaged. In circumstances where you consider that a product is defective, you should promptly contact us at sales@danellioc.com with details of the product and the defect. You will then be provided with instructions for returning the item you consider defective. Upon receipt of the returned product, we will fully examine it and notify you via e-mail, within a reasonable period of time, whether you are entitled to a replacement as a result of the defect. If you are eligible, we will send you a replacement product. Shipping charges for all returns must be prepaid and insured by you. If the product is deemed defective, we will refund any shipping charges paid to send the defective product back.

Reseller Policy

Danelli Ocular Creations LLC takes its responsibility seriously to protect its trademarks and brand from practices that may harm, diminish or dilute its brand or cause consumer confusion. To that end, DOC hereby adopts this Reseller Policy (“Policy”) and requires that each person, firm or entity (as applicable, a “Reseller”) that purchases DOC’s products (the “Products”) for resale or other distribution agree to comply with this Reseller Policy.

Accordingly, this Policy is incorporated into, and hereby supplements, any contract entered into between DOC and Reseller with respect to Reseller’s purchase or sale of the Products. Any Reseller failing to comply with this Resale Policy will face adverse consequences ranging from suspension up to and including, revocation of its Authorized Reseller status, immediate termination of its account, and/or further legal action.

No Resale on Online Marketplaces. Unless otherwise agreed with DOC in writing, Reseller may not advertise or sell the Products on the Amazon, eBay, Walmart or any other 3rd party online marketplace. Additionally, Reseller may not resell Products to any distributors for further distribution in any manner on the Amazon, eBay, Walmart or any other 3rd party online marketplace.
Compliance with MAP and MSRP. If DOC maintains a “minimum advertised price” or “MAP” or "Manufacturer's Suggested Retail Price" or "MSRP" or other policy that restricts the minimum price at which the Products may be advertised, Reseller may not advertise the Products at a price less than such minimum advertised price.
Handling and Storage. Reseller agrees to handle and store the Products in a safe manner and in compliance with DOC’s storage and handling guidelines.
Product Packaging. Reseller shall sell Products in their original packaging. Relabeling, repackaging (including the separation of bundled Products or the bundling of Products), and other alterations to Products or their packaging are not permitted. Reseller may not remove, translate, or modify the contents of any label or literature on or accompanying the Products. Reseller may not alter or remove any trademarks, proprietary notices or warning labels included in, on, or in connection with, the DOC products.
Report Unauthorized Resellers. If Reseller has information, or reasonably suspects, that any person is purchasing and reselling or distributing Products in a manner not authorized by DOC, Reseller must promptly notify DOC.
Support of Manufacturer’s Warranty. Reseller may extend to any proper purchaser of the Products the original manufacturer’s warranty in accordance with its terms. Reseller may not modify or alter the original manufacturer’s warranty, represent, or characterize the original manufacturer’s warranty in any misleading manner, or extend its own warranty with respect to the Products. Reseller must adhere to DOC’s warranty and customer support obligations and initiatives.

Privacy

See our Privacy Policy for information relating to our collection of information and your privacy rights. Be aware additional information may be collected by us or 3rd parties in order to complete your purchase and process your payment. At this time, we use Stripe for payment processing. Please see Stripe.com for additional information regarding their collection of information and privacy policies.

Choice of Law and Jurisdiction

This policy, and any dispute, which arises from and out of this policy or the purchase and/or use of any Product, shall be construed with the laws of the state of Indiana. Any legal action regarding this agreement or and Product shall be brought only in either the state or federal courts located within St. Joseph County, Indiana and by using this site you consent to personal jurisdiction within these courts.

DISCLAIMER OF WARRANTY AND LIMITATIONS ON LIABILITY

READ ALL PRODUCT PACKAGING, LABELS AND INSERTS BEFORE USING ANY PRODUCT AND MAKE SURE TO USE PRODUCTS ONLY AS DIRECTED.

TO THE EXTENT PERMITTED BY APPLICABLE LAW, BY DANELLI OCULAR CREATIONS LLC HEREBY DISCLAIMS ALL WARRANTIES. ALL PRODUCTS PURCHASED ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND. YOU ASSUME THE RISK OF ANY AND ALL DAMAGE OR LOSS FROM USE OF, OR INABILITY TO USE, THE PRODUCTS WE SELL. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE EXPRESSLY DISCLAIM ANY AND ALL WARRANTIES, EXPRESS OR IMPLIED, REGARDING OUR PRODUCTS OR SERVICES INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NONINFRINGEMENT.

LIMITED LIABILITY. TO THE EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DANELLI OCULAR CREATIONS LLC BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT DAMAGES ARISING FROM YOUR USE OF THE PRODUCTS. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED IN THESE TERMS OF USE, OUR LIABILITY TO YOU IN RESPECT OF ANY LOSS OR DAMAGE SUFFERED BY YOU AND ARISING OUT OF OR IN CONNECTION WITH USE OF THE PRODUCTS, WHETHER IN CONTRACT, TORT OR FOR BREACH OF STATUTORY DUTY OR IN ANY OTHER WAY SHALL NOT EXCEED THE AMOUNT YOU ARE ENTITLED TO PURSUANT TO THE RETURN AND EXCHANGE POLICY DETAILED ABOVE.

By purchasing DOC Products, you acknowledge and affirm your understanding, acceptance and agreement to all of the requirements herein. DOC reserves the right to take any action it deems appropriate to enforce these requirements.
